How can I pay my street / car park parking fine / ticket?

Car Park Parking Fine / Ticket

Fylde Borough Council, as the Off -Street Enforcement Authority is responsible for the enforcement of the car parks.. Civil Enforcement Officers (CEO) are able to serve PCNs on any day, and at any time to vehicles or motorists when a parking restriction is in force. Please note normal parking restrictions apply on public holidays unless signs on site indicate otherwise.

If you have parked in contravention of our parking regulation's you may be issued a Penalty Charge Notice (PCN). Here are some of the main reasons for the issue of a PCN, however this list is not exhaustive:

  • Parked in a Car Park without clearly displaying a valid pay & display ticket or voucher or parking clock.
  • Parked after expiry of paid for time.
  • Parked in a designated disabled person’s parking place without displaying a valid disabled person’s badge in the prescribed manner. (showing both valid badge and parking clock).
  • Not parked correctly in the markings of a bay or space.

All contact in relation to the issue of a Penalty Charge Notice on one of our car parks should be directed to Chipside Lancashire and not the parking services department at Fylde Borough Council.

Here is a brief outline of the process of what you can do, and what may happen:

PCN issued

Depending on the seriousness of the contravention, will determine if the penalty charge is issued at the lower charge (£50.00) or the higher charge (£70.00).

PAY PCN

You have 28days to pay the PCN before it progresses to the next stage. If you pay within 14 days of the PCN being issued you will benefit from 50% discount.

Challenge PCN

You have 28 days to make an informal challenge against the PCN (to Chipside Lancashire). If your challenge is received during the 14 day discount period and it is rejected, you will be offered a further 14 days to pay the PCN at the reduced rate. If the challenge is received outside the 14 day discount period the full charge will apply if your challenge is rejected.

Next Stage

If you ignore the PCN, do not pay or your informal challenge is rejected, a Notice to Owner (NTO) will be sent to the person or company that is the legally registered owner of the vehicle. At this stage, the full Penalty Charge Notice will be payable and no 50% discount will be offered.

This Notice goes to the person believed to be the owner of the vehicle as under the Traffic Management Act 2004. It is the owner of the vehicle who is liable for any PCN issued to it, irrespective of who the driver was. This is known as owner liability.

Notice to Owner

At this stage you have the opportunity to make formal representation against the PCN, within 28 days from which the notice was issued. The formal representation must be sent to Chipside, but will be reviewed by Fylde Borough Council. If your representation is rejected you will be sent a Notice of Rejection and will be liable for the full charge, which must be paid within 28 days of the date of the Notice of Rejection. With the Notice of Rejection, you should receive a form called a Notice of Appeal, allowing you to appeal to the Independent Parking Adjudicator.

You may only appeal to the Independent Parking Adjudicator if you have first used the Notice to Owner form to make representations to the council that issued the PCN and have received their Notice of Rejection of Representations. The Notice of rejection of representations is separate to an informal challenge rejection.

The decision made by the Independent Adjudicator is final and is binding on both the council and the appellant. Your ‘Notice of Rejection of Representations’ will explain how to complete this process.

Next Stage

If you do not pay within 28days of the issue of the NTO or the Notice of Rejection, or do not appeal to the Independent Adjudicator a Charge Certificate will be issued, which will increase the charge by 50%. Once the Charge Certificate is issued you will no longer have the option to appeal the PCN. If the charge still remains unpaid after the Charge Certificate is issued, it will be registered as a debt and another £7 charge will be applied.

If you ignore the PCN or do not pay, further action may be taken and could result in bailiffs being instructed to recover the charge. Additional bailiff charges may be applied.
