The preparation of the Core Strategy will take until 2013 and the Land Allocations DPD will take until 2014. There is thus a need for an interim policy to inform decisions on planning applications for new housing development.

A first round of public consultation on the scope of the Interim Housing policy was undertaken between 16th August and 14th September 2007. Taking the results of the consultation into account, a second round of public consultation on the policy options was undertaken between 10th January 2008 and 8th February 2008.

Taking into account all responses received, an amended report was produced and adopted by the Council on 28th July 2008. The Interim Housing Policy and associated documents can be viewed under 'downloads' to the right.

On 27 May 2010 the Secretary of State wrote to Local Planning Authorities and to the Planning Inspectorate informing them of the Government’s intention to abolish Regional Strategies in the Localism Bill and that he expected them to have regard to his letter as a material consideration in planning decisions.

On 6th July 2010 the Secretary of State for Communities and Local Government announced the revocation of Regional Spatial Strategies with immediate effect. In response to this on 5th August 2010 a Special Council Meeting of Fylde Borough Council agreed and endorsed the approach recommended by the LDF Steering group concerning progression of the Local Development Framework (LDF) and determination of planning applications. As part of adopting an Interim Position on Residential Developments it was agreed that the Council’s Interim Housing Policy should be subject to an addendum, which amongst other things, states that references to the RSS are no longer valid.

On 10th November 2010 the Chief Planner, Department for Communities and Local Government (DCLG), announced that the High Court had found that the powers set out in section 79 [6] of the Local Democracy, Economic Development and Construction Act 2009 could not be used to revoke all Regional Strategies in their entirety. The effect of this decision was to re-establish Regional Strategies as part of the development plan.

Subsequent to the High Court’s decision of 10th of November CALA Homes has issued a second claim, seeking a declaration from the Court that the government's stated intention to revoke Regional Strategies is not a material consideration for the purposes of making planning decisions. On 29th November 2010 the claim was expedited with the effect that a temporary block has been placed on the government's claim that its plans to abolish Regional Strategies must be regarded as a material consideration in planning decisions. Both the government's statement and the letter of 10th November 2010 are stayed until further notice.

Consequently the IHP addendum of 5th August 2010 is no longer valid. The Portfolio Holder for Planning and Development has subsequently regularised this by way of an individual cabinet member decision.

In summary the Council will continue to operate its Interim Housing Policy, as adopted on 28th July 2008, until further and more detailed guidance/policy is issued.
