Penalty for cafe owner
A café owner was punished with a curfew preventing him from leaving his house between 8pm and 6am when he appeared before Blackpool magistrates on 21 July.
David Rogers, of Manor Apartments, Poulton, was taken to court after Fylde Council staff discovered a number of food-safety concerns when they visited Café Vida on Park Road, St Annes in November 2009.
Rogers (53) pleaded guilty to three food hygiene offence and seven offences relating to Food Labelling Regulations.
The unusual curfew penalty, to last for four weeks, was imposed after magistrates heard that the business was suffering badly in the current poor economic climate. The offences were above the threshold at which community service orders could be imposed.
The council’s November routine visit revealed that high-risk foods such as cheese, coleslaw, pre-packaged salads and gammon had expired “use by” dates. No hot water was available for handwashing or equipment-washing purposes and handwash basins were not provided with any materials for handwashing. High-risk food was found to be displayed at a temperature above the required 8C.
The food business operator had provided a documented food safety management system, but this had not been satisfactorily implemented. Food safety officers considered this issue to be fundamental in the failure to maintain safe preparation, storage and management of food at the premise.
Councillor Cheryl Little, Fylde Council Cabinet Member for Social Wellbeing, said: “Responsibility for correct implementation of documented food safety management rests firmly with the operators of food businesses.
“The protection of public health is paramount for residents and the many visitors to the area. Action will be taken where this is not heeded.”
