Community Right to Bid

The Community Right to Bid

The Community Right to Bid allows communities and parish councils to nominate buildings or land for listing by the local authority as an asset of community value. An asset can be listed if its principal use furthers (or has recently furthered) their community’s social well-being or social interests (which include cultural, sporting or recreational interests) and is likely to do so in the future. When a listed asset comes to be sold, a moratorium on the sale (of up to six months) may be invoked, providing local community groups with a better chance to raise finance, develop a business and to make a bid to buy the asset on the open market.

The Community Right to Bid was introduced as part of the Localism Act 2011, and came into force in 2012. This page provides a gateway to a selection of resources about the process and contains Fylde Council’s list of assets of community value. As no unsuccessful nominations have been received, Fylde Council does not yet have a list of unsuccessful nominations.

For organisations who are considering nominating an asset, My Community Rights has an overview, detailed guidance and an advice service. Other links on this page will take you to the relevant legislation and the government’s guidance to local authorities administering the act.

List of land nominated by unsuccessful community nominations

Name of asset: Blackpool Airport Terminal Building, Squires Gate Lane, Blackpool FY4 2QY
Date of decision not to list and link to committee report: 21 March 2016
Reasons for decision not to list: The terminal building has been demolished and it is the settled intention of the owners to develop the site as a regional college providing specialist skills training for the energy industry. That development has the benefit of planning permission and the backing of key national and regional policymakers. The committee therefore felt that it was not realistic to think that there could be a time in the next five years when there could be a use of the land that could further the social wellbeing or social interests of the local community.

List of land previously, but no longer, listed as an asset of community value

Name of asset: Post Office Hotel, 18 Freckleton Street, Kirkham PR4 2SP
Date of decision to list and link to committee report: 6 June 2016
Date of listing: 6 June 2016
Reason for no longer being listed: Required to be removed from list by regulation 2(b) of the Assets of Community Value (England) Regulations 2012 because of a relevant disposal, the first moratorium period having expired without the second moratorium period being triggered.
